Charles Davis Charles Edward "Shorty" Davis, 67, of Mooresville, died July 19, 2002, at his residence in Mooresville.

The son of Edgar A. and Rosa E. (Gredig) Davis, he was born Dec. 20, 1934, in Blount County, Tenn. He married Linda K.

Coakley in June 1959. She is deceased. Davis worked in the Plant Maintenance Department of General Motors in Indianapolis for 30 years. He retired in 1993. He was a member of the St.

Thomas More Catholic Church and the American Legion Post 103, both in Mooresville. He was honorably discharged from the U.S. Army in August 1956. Survivors include two sons, Dwayne Davis Sr. and Steve Davis, both of Martinsville; a daughter, Lori Stoepker of Phoenix, three brothers, Robert Davis of Morgantown and James and Danny Davis, both of Tennessee; and four grandchildren.

A brother, William O. Davis, also preceded him in death. The funeral Mass will be 10 a.m. Thursday at St. Thomas More Catholic Church in Mooresville.

Martin, 78, of Martinsville, died at 9:30 p.m. July 21, 2002, at Methodist Hospital in Indianapolis. The daughter of Charles and Elizabeth (Harvey) James, she was born June 12, 1924, in Martinsville. She married Clinton E. Martin Oct.

24, 1943. He died April 12, 2002. Mrs. Martin was a homemaker. Survivors include two daughters, Penny Crawley and Jeannie Hadley, both of Indianapolis; a brother, Lloyd James of Bloomington; a sister, Josephine Horvath of Martinsville; four grandchildren, Jodi Lopossa, Jennifer Sloan, Jeff Crawley and Jaime Morris; and six great-grandchildren.

Born Nov. 6, 1941, in Indianapolis, she was the daughter of Ernest Clyde Grider and Margie a i (Hardesty) Poynter, both deceased. She married Kenneth L. Roth Aug. 24, 1991.

He survives in Mooresville. Mrs. Wright-Roth was a selfemployed Nail Technician for 15 years at Nails by Judy in Mooresville. She retired in 2000. She was a member of the Plainfield Christian Church in Plainfield and the Mooresville Veterans of Foreign Wars Ladies Auxiliary Post 1111, Mooresville American Legion Ladies Auxil-194 iary 103 and the Mooresville Eagles Lodge 3988.

Other survivors include two sons, Kenny Wayne Roth and Uwe Roth, both of Camby; three daughters, Tina McClain of New Palestine, Christina Bain of Martinsville and Erika Lynn Whitehair of Florida; three brothers, George Poynter Jr. of Mooresville, Randy Poynter of Plainfield and Steven Poynter of Monrovia; two sisters, Kathy Seitz of Indianapolis and Vicki Travis of South Carolina; and eight grandchildren. Two brothers, James Grider and Bobby Poynter, preceded her in death. The service will be 11 a.m. Thursday at Carlisle Son Funeral Chapel in Mooresville.

Frank O'Bannon will likely miss a June 2003 deadline for closing the Muscatatuck State Developmental Center in southern Indiana, but his administration remains determined to move residents to new homes. State officials are pressing ahead with plans to close Muscatatuck, despite court rulings and a new law that gives family members power to veto new placements for residents. A new closing date has not been determined.

"It's gotten a little complicated," Andrew Stoner, deputy press secretary for O' Bannon, told The Courier-Journal of Louisville, for a story published Tuesday. The state's Division of Disability, Aging and Rehabilitative Services is working with about 100 of Muscatatuck's remaining residents to find appropriate treatment services in community-based settings, including group homes and assisted-living apartments. Most of those residents are profoundly mentally retarded, and many also suffer other serious health problems. Steve Cook, director of the disability division, said about 30 residents could move to new homes by September. About 70 more are in the planning stages for a move.

Remaining residents are not yet involved in the planning because their families oppose moving them from the center, Cook said. Those families have been emboldened by recent court and legislative decisions that give them more authority to keep their loved ones at Muscatatuck. Jackson County Circuit Judge William Vance ruled in April that the state cannot move residents out of Muscatatuck without written approval from their guardians. The ruling also prohibits the state from reducing staff at the center. State officials have preserved their right to appeal the decision but have not yet done Meanwhile, the General Assembly overrode O' Bannon's veto of a bill that gives families more power to decide when and whether Muscatatuck residents are moved.

"People are understanding that they do have some rights," said Frank Migliano, president of the Muscatatuck Association for Retarded Citizens and the father of a resident. "The state can't make them do Under pressure from Senate Republicans, O' Bannon announced last year that he would close Muscatatuck by June 2003 and move most of the residents elsewhere. John Dickerson, executive director of the ARC of Indiana, an advocacy group, supported the decision to serve Muscatatuck residents in the community, rather than in the institution. But he said the timeline was too ambitious. Recent delays have given the state time to develop transition teams to help family members find the most appropriate settings for their loved ones, he said.

"It's a better process now than it was a year ago," Dickerson said. The delays also mean that families have had more time to accept what Dickerson believes is inevitable: that Muscatatuck will close. "More families have gone beyond the initial anger and hostility and started looking at their choices," Dickerson said.
